Terms and conditions of sale

Article 1 — Purpose & scope
These terms and conditions of sale (the “Terms”) apply to all orders placed on the biopeptides.fr website, published by BIOLAB SOLUTIONS LLC, a company registered in New Mexico (USA) — registered office: 8206 Louisiana Blvd NE, Ste A #10306, Albuquerque, NM 87113; EIN: pending issuance — operating the BioPeptides brand (the “Seller”).
They govern all contractual relations between the Seller and any adult natural person or legal entity (the “Customer”) placing an order on the Site. Any order implies full and unreserved acceptance of these Terms. The applicable Terms are those in force at the time the order is placed; the Seller may amend them at any time.
Article 2 — Nature of products & authorised use
The products sold on the Site are synthetic peptides intended exclusively for in vitro biomedical research. They are neither medicines, food supplements nor cosmetics, and hold no marketing authorisation.
Disclaimer: the products are not intended for any human, animal, food, cosmetic or therapeutic use. Any misuse (ingestion, human or animal injection, resale for therapeutic purposes) engages the Customer's sole responsibility and fully releases that of the Seller.
International notice: “FOR RESEARCH USE ONLY — NOT FOR HUMAN CONSUMPTION. This product is intended for laboratory research use only. Not for human, veterinary, diagnostic, or therapeutic use.”
The Customer acknowledges having the scientific skills, equipment and authorisations required to handle these compounds in a professional or academic research setting.
Article 3 — Eligibility: age & buyer status
Sales are strictly reserved for adult natural persons (18 years or older) and qualified legal entities: research laboratories, universities, scientific centres, biotechnology companies and establishments justifying a research activity.
When confirming the order, the Customer certifies, via a mandatory checkbox, (i) being of legal age under the law applicable in their country of residence, (ii) ordering exclusively for laboratory research purposes, and (iii) taking full responsibility for the use they will make of the products.
Any false declaration regarding the age or status of the Customer voids the contract, cancels the order without refund and may lead to prosecution. The Seller does not deliver to minors.
Article 4 — Order
The Customer places an order by selecting the products, confirming the cart, entering delivery details and completing payment. The order is definitively concluded upon receipt of payment.
A confirmation email, summarising the order and serving as a pro forma invoice, is sent to the address provided. The Seller reserves the right to refuse or cancel any order for legitimate reasons: suspected fraud, prior dispute, abnormal order, stock shortage, obvious pricing error or inability to deliver to the stated country.
Article 5 — Prices & payment
Prices are shown in euros (€), excluding shipping costs. Shipping costs are calculated and displayed before the order is confirmed. Products are invoiced on the basis of the price in force at the time of confirmation.
Depending on the destination country, any customs duties, taxes or import fees may apply and remain the Customer's responsibility.
Payment is made online by bank card via a secure payment platform (PCI-DSS standard); no card data is stored on the Seller's servers. Other payment methods may be offered at checkout.
Article 6 — Delivery
The products are shipped from our partner laboratory. The delivery time is indicative: approximately 8 days. A tracking number is provided for every order.
The Buyer is solely responsible for the compliance of importing the products into their country and for paying any customs duties. The Seller cannot be held liable for any customs hold, seizure or import refusal.
A delivery delay cannot give rise to any compensation, cancellation or claim, unless it exceeds 30 days from the order date (Article L.216-6 of the French Consumer Code).
Article 7 — Packaging & discretion
All parcels are shipped in neutral packaging, with no mention of the contents or reference to the activity on the outside. The stated sender is a neutral entity.
Peptides are delivered in lyophilised form, stable at room temperature during transport.
Article 8 — Right of withdrawal
In accordance with Article L.221-18 of the French Consumer Code, the consumer Customer has 14 calendar days from receipt of the product to exercise their right of withdrawal, without justification (excluding return costs).
Exception: in accordance with Article L.221-28 3° of the French Consumer Code, the right of withdrawal does not apply to sealed products that cannot be returned for health or hygiene reasons and that have been unsealed after delivery. Sealed vials fall into this category: once the seal is broken or reconstitution is carried out, the right of withdrawal is extinguished.
Article 9 — Conformity & warranty
Each batch comes with a certificate of analysis (CoA) stating the HPLC purity (≥ 99%) and the batch specifications, available on the Lab results page.
In the event of a non-compliant, defective, damaged-on-delivery or incorrect product, the Customer has 14 days from receipt to inform the Seller at contact@biopeptides.fr, attaching photographs and the order number.
The Seller undertakes, at the Customer's choice, to replace the non-compliant product or to refund it in full (product + shipping costs) within 14 days of the return agreement.
Article 10 — Liability
The Seller's liability is limited to supplying products compliant with the order and delivering them under the conditions set out in these Terms. The Seller cannot be held liable for indirect damages (loss of data, loss of business, commercial or moral prejudice) resulting from the use of the products.
The Customer, solely responsible for the use they make of the products, undertakes to comply with the applicable local regulations, in particular regarding scientific research, the handling of chemical substances and occupational safety.
Article 11 — Chargebacks & payment disputes
By completing a purchase, the Customer acknowledges that initiating an unfounded chargeback constitutes a breach of these Terms. The Seller may provide the payment provider with evidence of order, tracking and delivery, pursue recovery of the unpaid balance and refuse any future order.
Article 12 — Intellectual property
All content on the Site (text, design, logos, product data, images and tools) is the exclusive property of BIOLAB SOLUTIONS LLC / BioPeptides. Any reproduction, distribution, automated extraction or commercial use without prior written authorisation is strictly prohibited.
Article 13 — Force majeure
The Seller's liability cannot be engaged in the event of failure or delay due to force majeure within the meaning of Article 1218 of the French Civil Code: an external, unforeseeable and irresistible event (strike, weather, armed conflict, pandemic, administrative decision, customs incident, etc.). The Seller will inform the Customer as soon as possible of the consequences for the fulfilment of their order.
Article 14 — Personal data protection
Personal data collected as part of the order is processed in accordance with the Site's privacy policy. The Customer has the rights of access, rectification, erasure, objection, restriction and portability provided for by the GDPR.

Article 15 — Governing law & dispute resolution
These Terms are subject to French law for relations with consumers established in France. In the event of a dispute, the consumer Customer is invited to contact customer service for an amicable resolution (contact@biopeptides.fr).
Failing an amicable agreement, the consumer Customer may use, free of charge, the European online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr. Failing an amicable resolution, the French courts shall have jurisdiction; for B2B relations, exclusive jurisdiction of the Paris Commercial Court.
